  17. <p>    As if There weren't enough controversy surrounding SPIKE
  18. LEE'S upcoming bio flick, Malcolm X. Now the fiery auteur is
  19. waging a legal battle to retain the right to use 45 seconds of
  20. footage from the Rodney King beating in the opening scenes of
  21. the film. George Holliday, the man who made the tape, is suing
  22. Lee, claiming his original arrangement with the filmmaker was
  23. invalid. "It's a done deal. We have a contract; he cashed the
  24. check," says Spike. Malcolm X is expected to hit theaters this
  25. November.
